Can I Control My Regrowth Vegetation?

Woody native vegetation that has regrown in managed native pastures since 1 January 1990 and was not cleared unlawfully or through natural causes (such as bushfire), does not require a certificate for its removal under Part 4 Continuing Use, Division 1 of the Land Management (Native Vegetation) Code 2018 on rural land.

You can compare historic spatial imagery from 1990 to present-day spatial imagery to assess native vegetation change over time. If there is evidence of cleared pastured paddocks at 1990, and the vegetation cover in the previously cleared areas has extended, this may authorise the clearing of only trees and shrubs back to the same extent as in the 1990 image.

Clearing on Category 2-vulnerable regulated land (steep slopes and creeks) and within the buffer distance of water bodies must be done by clearing individual trees with nil disturbance to soil and groundcover. Please check carefully for and avoid harm to threatened species before undertaking native vegetation management. Other conditions and approvals may apply.

Regrowth
